Information on the protection of personal data

This data is used to provide information on the rights of affected persons (our clients and other natural persons), whose personal data is processed by our firm LawService Recovery, k.s., with its registered office at Stráž 223, 960 01 Zvolen, IČO: 47 817 003, entered in the Commercial Register of the District Court. of the Court Banská Bystrica, Section: Sr, File No .: 602/S, as an operator (hereinafter also referred to as the “Operator”) in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to processing personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR Regulation”), Act no. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts (hereinafter referred to as the “AoPPD”), Act no. 7/2005 Coll. on Bankruptcy and Restructuring, (Act on Bankruptcy and Restructuring) Act. no. 8/2005 Coll. on Trustees to Act No. 455/1991 Coll. on Trade Licensing (Trade Licensing Act) as amended, as well as other regulations.

Operator's activities

Our company performs activities that consist mainly of:

• In the performance of trustee in accordance with the Bankruptcy and Restructuring Act - management of the debtor's assets, monetizing it and satisfying creditors' claims.

• In the performance of various legal obligations;

• In protecting of our legitimate interests as well as the interests of others.

What is personal data and what is meant by the processing of personal data?

Personal data within the meaning of the applicable legislation is data relating to an identified natural person or an identifiable natural person who can be identified directly or indirectly, in particular by a generally applicable identifier, another identifier such as first name, surname, identification number, location data, or an online identifier, or based on one or more of the characteristics or traits that make up its physical identity, physiological identity, genetic identity, mental identity, economic identity, cultural identity, or social identity.

Processing of personal data means a processing operation or set of processing operations involving personal data or personal data files, in particular the acquisition, recording, organization, structuring, storage, alteration, retrieval, browsing, use, transmission, dissemination or otherwise, regrouping or combining , restriction, deletion, whether carried out by automated means or by non - automated means.

Which legal basis do we use when processing your personal data?

We are only entitled to process your personal data in a lawful manner and in such a way that your fundamental rights are not violated. We process your personal data on the basis of (at least one of) the following legal bases:

• Based on your consent to the processing of your personal data for at least one specific purpose, and only if it is not possible to process personal data on another legal basis;
• The processing of your personal data is necessary for the fulfilment of our legal obligation as an operator, especially for the fulfilment of obligations arising from law regulations (especially the Act on Bankruptcy and Restructuring), accounting regulations, the Archives and Registries Act, as well as for fulfilling obligations in relation to state authorities;
• The processing of your personal data is necessary for the purposes of legitimate interests which we pursue or which are pursued by a third party, and we use this legal basis in particular:
• To send newsletters to our clients in order to provide information on legislative changes or legal news, as well as to send holiday greetings;
• To monitor the traffic of our website, to improve the functioning of our website (through “cookies”), but so that when using this purpose, it does not unduly interfere with your rights;
• To monitor the exterior and interior of the building where our company is located, in order to protect our property from destruction, damage or theft, as well as to protect the health and safety of persons located on the premises of our company.

Tha purpose of personal data processing

We process your personal data to the extent and in the manner defined by the following categories of purposes:

1. Exercise of the profession (provision of legal services)
   Fulfilment of the legal obligation according to Art. 6 par. 1 letter (c) the GDPR (in relation to specific categories of personal data, these may be additional conditions under Article 9 (2) (f) of the GDPR) and, where applicable, the performance of the contract under Article 6 (2). 1 letter b) GDPR

2. Provision of non-legal services
   Performance of the contract pursuant to Article 6 para. 1 letter b) GDPR or, where applicable, the fulfilment of the legal obligation pursuant to Art. 6 par. 1 dog. c) GDPR

3. Marketing purposes (sending newsletters, cookies)

What personal data do we process?

If you are our client, we most often obtain your personal data directly from you.

In this case, obtaining your personal data is voluntary. Depending on the specific case, the non-disclosure of personal data to clients may have an impact on our ability to provide quality legal advice or, in exceptional cases, our obligation to refuse to provide legal advice.

We may also obtain personal information about our clients from publicly available sources, from public authorities or from other persons.

If you are not our client, we most often obtain your personal data from our clients or from other public or legal sources such as by requesting from public authorities, extracts from public registers, obtaining evidence in favour of the client, etc. In such a case, we may obtain personal data about you without informing and also against your will on the basis of our legal authorization.
